PSI‘s Action for Patent Infringement against iST, the Court of Second Instance Continued to Judge PSI’s Patent Invalid

Regarding Phoenix Silicon International Corporation (“PSI”) appealed against the first instance judgement of the Intellectual Property Court (“IPC”) in June 23, 2020, and continued to allege that Integrated Service Technology (“iST”) infringed upon the R.O.C. Invention patent no. I588880. The court again invalidated PSI’s patent no. I588880.

As the first instance judgment of the IPC, in the second instance of the IPC, it is still considered that the patent no. I588880 of PSI belongs to the easy combination of common knowledge, and it is not progressive. Therefore, the court ruled that the patent was invalid.

Even PSI admitted in court that every step of its wafer thinning process was a learned technique, meaning that the steps of the wafer thinning process were known to the industry.

In particular, in case B, PSI sued iST and its employees for violating its business secrets. The employee never worked for PSI and his previous employer had stressed that this was not a business secret. iST is sorry to find that PSI does not compete in the market by technology, but repeatedly use the means of litigation to interfere with the market.

iST sincerely appreciates the result of the trial by law, and PSI also admitted that every step of its wafer thinning process was a learned technique. This result proves iST never infringes upon the rights and interests of others. iST also would like to further announce that we will not tolerate any market manipulation of anyone else by arbitrary accusation.
